1. Introduction
The Carer’s Leave Act 2001 provides for an entitlement to carer’s leave for an employee who wishes to leave employment temporarily to provide full-time care and attention to a relevant person. The entitlement is significant in scope, providing up to 104 weeks of unpaid leave in respect of any one relevant person.
This article addresses the carer’s leave entitlement, the qualifying conditions, the procedural requirements, the protections, and the practical implications for both employers and employees.
2. Legislation and Case Law
Section 6 of the 2001 Act provides that an employee who has been in continuous employment with his or her employer for a period of 12 months is entitled to leave from his or her employment to enable him or her to personally provide full-time care and attention to a relevant person. The maximum entitlement is 104 weeks in respect of any one relevant person.
Section 4 defines ‘relevant person’. A relevant person is a person who has been determined, by reference to the criteria in the Carer’s Benefit Act 1999, to require full-time care and attention. The determination is made by the Department of Social Protection.
Section 8 sets the procedural requirements. The employee must give the employer not less than six weeks’ notice in writing of the intended commencement of the leave. The notice must be accompanied by a Carer’s Leave Decision from the Department of Social Protection.
Section 11 provides that the leave may be taken in one continuous period or in separate periods of at least 13 weeks each. The flexibility allows the employee to manage the care obligation alongside the employment.
Section 13 provides for the protections during the leave. The contract of employment is preserved, and the employee retains all rights and obligations associated with the employment, save for the right to be paid.
Section 14 provides for protection from penalisation. The penalisation provisions mirror those in the Parental Leave Acts and the Paternity Leave Act.
3. Decision
WRC decisions on carer’s leave have addressed the qualifying conditions, the procedural requirements, and the operation of the protections. The decisions emphasise the protective purpose of the regime and the need to facilitate genuine care obligations.
On the qualifying conditions, the Adjudication Officer has applied the relevant person test by reference to the Department of Social Protection’s determination. The employer is not in a position to second-guess the medical assessment that underlies the determination.
On the procedural requirements, the Adjudication Officer has held that the six-week notice period is substantive. Compliance with the notice period is a precondition of the entitlement, but the period may be shortened by agreement or where the circumstances justify a shorter period.
On the protections, the Adjudication Officer has applied the Section 14 penalisation provisions broadly. Adverse treatment in connection with carer’s leave attracts liability.
Where the entitlement is denied or the protections breached, the WRC may award compensation reflecting the seriousness of the breach. The substantial duration of the leave (up to 104 weeks) makes compliance with the regime particularly significant.
4. Takeaway
For employers, the carer’s leave entitlement is a substantive right and should be facilitated. The duration of the leave (up to 104 weeks) means that operational planning may be required, and employers should engage with the employee in advance.
The employer is also entitled to require evidence of the relevant person’s status, by reference to the Department of Social Protection’s determination. The evidence may be requested but the determination itself is not open to challenge in the employment context.
For employees, the entitlement is significant but procedurally complex. Practitioners should assist with the application for the relevant person determination, the preparation of the notice to the employer, and the management of the return to work.
Practitioners should also consider the interaction with other entitlements, including parental leave, force majeure leave, statutory sick leave, and the right to request flexible working under the Work Life Balance Act 2023. A care obligation may give rise to entitlements under multiple regimes.
