1. Introduction
Section 14 of the Organisation of Working Time Act 1997 requires that employees who work on a Sunday be compensated by a reasonable allowance, a reasonable premium rate, or a reasonable adjustment to the working day, unless the contractual hourly rate already takes the Sunday work into account.
This article considers the meaning of “reasonable allowance”, the case law on Sunday premiums, and the practical issues that arise in industries such as hospitality, retail and healthcare.
2. Legislation and Case Law
Section 14(1) of the 1997 Act provides that an employee who is required to work on a Sunday must be compensated by one of the following methods: (a) the payment to the employee of an allowance; (b) the increase of the employee’s basic pay; (c) the granting of paid time off; or (d) by a combination of two or more of the foregoing.
The compensation must be reasonable having regard to all the circumstances. The Labour Court in Park House Hotel v Edyta Wlodarczyk DWT1611 held that an addition of one-third to the basic hourly rate has commonly been considered reasonable, though the assessment is fact-specific.
Section 14(2) provides that where the contractual rate already takes account of Sunday working, no additional payment is required. The burden rests with the employer to demonstrate this and to identify the specific element of the rate attributable to Sunday work.
The Labour Court in Viking Security Limited v Valent DWT1489 confirmed that a generic statement in a contract that the rate “includes Sunday premium” is insufficient. The employer must be able to identify the specific premium element.
3. Decision
The WRC will examine whether the employee worked on Sundays during the cognisable period and whether the employer provided one of the Section 14 benefits. Where the employer relies on contractual incorporation, the WRC will scrutinise the contract for specificity.
Where the contractual hourly rate is at or near the National Minimum Wage, it is difficult to argue that the rate already includes a Sunday premium. The premium must be identifiable as an additional element.
Compensation under Section 27 may include the value of the unpaid premium over the cognisable period, together with an additional element for the breach.
4. Takeaway
Employers should review contractual provisions for Sunday work to ensure that any premium is clearly identified as a separate component of pay. Generic clauses incorporating Sunday work into the basic rate are typically insufficient.
Employees who work regularly on Sundays should review their pay slips and contracts. Where no premium is paid and the contract is silent or vague, a Section 14 complaint may be appropriate.
